Sometimes the laws make no sense to me

Tell me something — HOW does someone plead guilty to wholesale promotion of obscene materials when there has been NO trial or prosecution stating the materials were obscene???

Granted, this guy produced porn in Florida and it’s only legal to do so in California, but Florida is known for its porn production.

I don’t like this. I can’t fathom why Larry Walters would allow his client to plead guilty UNLESS something new came to light recently that isn’t being made public … but still, no prosecution on obscenity but he plead guilty to it …

PENSACOLA, Fla. – The trial for adult webmaster Clinton McCowen, aka Ray Guhn, ended before it began. According to a news report, Guhn appeared in court yesterday and pleaded guilty to an “unlawful financial transactions” charge, thus avoiding a trial.

Shortly before midnight, The Pensacola News Journal reported that Guhn and his associates, all principals with the Cash Titans program, pleaded guilty to various charges – but not obscenity. According to the article, Guhn will be sentenced to three to five years in state prison.

Cash Titans general manager Andrew Craft, and Guhn partner Kevin Stevens, pleaded guilty to one count of racketeering and are facing two to four years in prison. Another defendant, Thomas Dwyer, pleaded guilty to wholesale promotion of obscene materials.

All remain free on bond before sentencing on Aug. 11.

Global Technologies Inc., doing business as Ray Guhn Productions and Cash Titans, made $10 million in its first five years, prosecutors alleged, while it shot adult Internet content in homes, at hotels, along the interstate and in public in Pensacola and Pace, Fla.

Guhn was initially charged by Escambia County prosecutors in June 2006 with racketeering, enterprise prostitution and the production and sale of obscene material. Escambia County then dropped the charges before refilling the racketeering and money laundering charges in neighboring Santa Rosa County in July 2007.

“We have this [porn] problem statewide,” Assistant State Attorney Russ Edgar, who prosecuted the case, told the Pensacola News Journal. “I hope prosecutors will take our lead and enforce our law.”

Guhn’s lawyer Lawrence Walters was quoted in the New York Times earlier yesterday for employing a novel defense strategy. In regards to the community standards prong of the Miller test, Walters sought to use Google Trends search data of Pensacola residents to buoy his claim that local community members have an active interest in sexual content.

Judge Ron Swanson ruled that the community in this case was defined as the counties that make up Florida’s First Circuit Court: Escambia, Santa Rosa, Okaloosa and Walton.

“Time and time again you’ll have jurors sitting on a jury panel who will condemn material that they routinely consume in private,” Walters told the Times. “Utilizing search queries] we can show how people really think and feel and act in their own homes, which, parenthetically, is where this material was intended to be viewed.”

By pleading guilty to racketeering, Guhn avoided an obscenity trial.

Walters was unavailable for comment at press time.

Basically the government passed new laws last year that would have made it virtually impossible for adult websites to be on the Internet. Fortunately the court agrees with the majority of webmsters about how this law is too broad and could have deadly consequences.

6th Circuit Court of Appeals Rules 2257 Unconstitutional
Court holds that statute is overbroad, cannot be narrowed except through fundamental revisions by Congress.

CINCINATTI — The 6th Circuit U.S. Court of Appeals ruled today that the federal record-keeping statute 18 U.S.C. 2257 is unconstitutional, holding that the law is overbroad and facially invalid.

The court’s decision came in the case Connection Distributing vs. Gonzales, a case that reaches all the way back to 1995, when Connection, a publisher of swingers-themed magazines and websites, first challenged the constitutionality of 2257. Following a long history of rejections and appeals, the path eventually led back to the 6th Circuit court of appeals, and today’s ruling.

Writing for the majority, Judge Cornelia G. Kennedy stated in the opinion that the court’s hands were tied in terms of trying to impose any limiting construction on the statute that would comport with the intent of Congress, leaving Congressional amendment of the statute the only option for rendering 2257 constitutional.

“The plain text, the purpose and the legislative history of the statute make clear that Congress was concerned with all child pornography and considered record-keeping important in battling all of it, without respect to the creator’s motivation,” Kennedy wrote in the opinion. “There is, therefore, no narrowing construction.”

The government argued in the case that 2257 was aimed only at conduct and not speech. Had the court accepted this argument a lower standard of review would have been applied, and the court may have ruled that 2257 was a valid regulatory statute. The court rejected the government’s assertion that 2257 merely regulates conduct, however, in very direct fashion.

“This argument is unpersuasive,” Kennedy wrote. “While the government is indeed aiming at conduct, child abuse, it is regulating protected speech, sexually explicit images of adults, to get at that conduct. To the extent the government is claiming that a law is considered a conduct regulation as long as the government claims an interest in conduct and not speech, the Supreme Court has rejected that argument.”

Kennedy also noted that the child abuse, “the actual conduct in which the government is interested, is already illegal.”

“Child pornography, while speech, can be considered more like conduct because the conduct depicted is illegal, and if that illegality did not occur, no images of child pornography would be created,” Kennedy wrote. “Adult sexual conduct is not illegal and it is in fact constitutionally protected … The regulation of visual depictions of adult sexual activity is not based on its intrinsic relation to illegal conduct. It is, therefore, a regulation of speech, because both the photograph and the taking of a photograph ‘bear … [a] necessary relationship to the freedom to speak, write, print or distribute information or opinion.’”

Kennedy said the court was not unaware of the serious scourge of child pornography — it just believes that there has to be a less burdensome option for attacking the problem.

“We do not belittle the despicability of child pornography, and we appreciate the difficulties faced by the government,” Kennedy wrote. “There are a myriad of limitations available, however, that would reduce the breadth of the recordkeeping requirements and would more narrowly focus on the government’s interest and therefore remove some of the protected speech from the statute’s coverage. Such limitations have been suggested by witnesses who testified before Congress and by the plaintiffs here.”

Lots of heavy rain, thunder and lighting right now … I got caught in the downpour several times today. Too humid to wear a coat so I got soaked. Could not wait to get home and shower!

Did you catch Britney Spears on the VMAs the other night? First, I don’t think she was “fat” but she was not in the shape she used to be. Whomever suggested she wear a bikini was not thinking of her best interests. She moved around as if she wanted to be elsewhere, or was very drunk or high. Her lip synching was bad, her moves were barely there, she almost tripped …. what a train wreck.

Last night I wanted to watch a rerun but by 8 PM I was so tired I went to bed. Missed chatting with several people but I was dead tired and figured I needed the rest.

Decided against meeting Bruno (the 23-year old) due to his “ima be all ova u” comment. I just won’t be comfortable so will pass on it. The new guy who is local invited me to dinner but I told him I’d commit to coffee and nothing else. He’s not into cars at ALL so I don’t think there is a chance of any type of relationship. The other guy who is an hour away and I can’t seem to get together online to talk. I like him but think the distance would be an issue. It’s sad that the ones I want are either too far away, taken, or not interested.

I did hear from someone from my past today and it’s been about a year since I’ve heard from him, and I haven’t seen him in nearly 3 years. We met from a dating site but like most guys on dating sites, he lied to me … age, and other things. He didn’t treat me very nicely when we met and I told him that last year and asked him to go away, but he emailed to ask how I was. Not sure why but I certainly don’t want to bring him back into my life.

Going to update Hairy Websites tonight which I’ve been meaning to do … is there ever enough time in a day?

Been a hell of a week

My ego has taken a huge beating this week, I tell ya. There was the liar I spoke about who disappeared after I told him I wasn’t going to meet him AND have sex. I haven’t a clue why he thought that considering I told him in the beginning I’d not do that, but obviously he wanted more and if he was the right kind of guy, he’d have stuck around.

Then there was the local guy who wanted a woman with huge tits and won’t settle for less. Thanks for making me feel inadequate.

And, the guy with the goatee and hot rod who doesn’t like hairy arms and legs (and I never told him I had either).

Let’s see, the young one who I like but who lives 1000 miles away and obviously has no plans to move here.

The one an hour away who loves BBWs but neither of us are premium members of a dating website so once we wink at each other, that’s all we can do. Or there is a local guy into BBWs and hairy women but it’s the same thing, neither of us are premium members and I’m just too cheap!

So, what do you think of the Paris Hilton situation? I’m glad she’s back in jail. She isn’t above the law and had she just stuck to the terms of her probation she’d not be in jail now. You can’t keep getting out of things with daddy’s money. She was on the red carpet giving this bullshit about wanting to serve her full sentence and learning from it, but once she found out she had to go back she was in tears and hysterical. Let her stay there 45 days and learn there are consequences to your actions.

Mailman just was here and brought me my carb. I haven’t opened it yet but I can’t wait to open it and actually look at it carefully. I have an appointment to have it installed next week and this should fix my problem once and for all. 2 rebuilds on a piece of crap was enough for me.

I’m now looking for a daily driver classic car, so if you know of a rust-free car, let me know. I’m looking at 1969-72 Mustangs (I know, I used to hate that style, huh?), 1969 Firebird or Camaros, or a Dodge Dart. Saw some online but either they are overpriced or I don’t believe they are described accurately. I did see a really nice 1965 Mustang convertible this week and seriously want a convertible for the summer, but they wanted more than twice the worth of the car plus it had rust that even *I* could see. I don’t want anything needing any sort of restoration at this point since my other car is still being done. A 1950’s truck would be the perfect daily driver.

33 people dead and 30 more injured in the shooting at Virginia Tech. How horrible. When I went into Dunkin Donuts this morning for coffee, the TV was on and they said one person was dead … by the time I got home it was up to 21. Now 33 including the gunman, a younger Asian man supposedly.

With all this tragedy going on today, I almost hate to admit that I’m frisky today. There is a new guy on the horizon who is from my hometown and we have a lot in common, though he’s admittedly not into hairy women, so that may be a huge issue if we ever meet. He’s already backed off a little bit since being told I was hairy, but that still doesn’t stop me from being frisky and thinking of him.

Dad needs another transfusion as he’s been going downhill for the past week and I’m pretty sure he’ll be back in the hospital in a day or two.

Survived the ‘Noreaster with very little damage, no water damage and no loss of power. I wanted to go check on the progress of my car today but it was too icky out. I did find a 3rd garage space to rent which is great news.

Still alive but barely! Moving sites, nearing the end thank goodness. Right now Hairy Chat should almost be ready to be viewed, and Pam’s Reviews is moved and DNS is propagating. Just a few more sites to move and then I am taking a vacation. Oh yeah, I moved Hairy Pits and you should be able to login now, finally, as I had a few minor issues with it.

I was supposed to go to court tomorrow for a payment review hearing, as they had 30 days to pay me, as of the 17th of January. Of course, today I receive the check so now I have to call the court early in the morning since my hearing was at 9 am. It’s 5 days late but I doubt the court will do anything.

I watched most of American Idol last night and of the 12 guys, no one stuck out and truly impressed me. I do favor Blake, Chris Sligh and the Chris Daughtry-look-a-like. The women perform in about 10 minutes and I’ll watch most of it.

Tired of reading about Anna Nicole and Britney? Who cares already? Sheesh, it’s ridiculous. This woman, Britney, is a lousy role model and I wonder who is taking care of her kids while she’s out drinking, shaving her head, having tattoos and going in and
out of rehab.

Dad is still at the home, his knee is horribly swollen and bruised from when he fell, and I think he’ll be there an extra few weeks to recover from this. I didn’t go visit him today since I had too much to do but will go tomorrow.

Got prices on shipping my car from California. When I had the last one shipped from there in July, gas prices were much higher and I paid $1,800 which was a phenomenal price for a covered carrier. The price is actually more now, which makes no sense since prices have gone down, but they did such a great job and I liked the 2-level carrier.

52 degrees yesterday, what a break! I wore a lighter coat and last night, kicked off the heavier blanket since it was 32 overnight. Extended forecast says from Friday until next Friday it will be close to 40 every day.

I’m watching them but honestly, work is more exciting. I really was looking forward to the reunion of The Police but Roxanne was not done very well, if you ask me. So far the most exciting thing has been … well, nothing. John Legend was a little off and I like Corinne Bailey Rae but she was just ok. Shakira is on now and I don’t like her at all.

One pithy email from the new guy who I think is losing interest, or he’s just not much or a writer or emailer. Kinda hoped he’d still be around for Valentine’s Day.

Updated a lot of sites today, most notably Pam’s Reviews where I moved a lot of stuff off the main page to tidy it up and added some new stuff as well. No word from my designer today so nothing new to launch today, so Summer can’t yell at me!

Oh yeah, Eddie, when you called, I forgot to mention the tilapia!! It was just as good tonight when I made it, if y’all have never tried it, you really have to!

What an odd day

First, I was able to finish off a site I wanted to put up for a long, long time and Hairy Hotties is finally done. I’ve had the domain for years and now I can say I finally did something with it.

Got an email from a new guy who sounded promising, although young, but then he asked me about my past marriages. Maybe in another life! We’ll see how it goes with him, but he’s not close by which could be an issue.

Then a customer called to ask some questions. First odd thing was when he asked about my “husband” who helped me produce my first 2 videos. Why does everyone have me married all of a sudden? Then he’s telling me about videos he has by Joe Elliot, and asked why I don’t sell them, etc. Then he says to me that he liked the videos by “that Jew mother fuck.” Seriously. I didn’t say a word for about 30 seconds, and he asked if he said something wrong. Duh? He was going to drop $200+ on videos and I was going to offer him a discount, so am glad I didn’t. Stupid prig. He called back tonight but I let voice mail get it.

Dad is coming along. Monday, most likely, he’s being moved to a convalescent home specializing in rehab services. He should be there at least a month. His pneumonia is coming along, no more bleeding due to the medication adjustment, but he still can’t walk and his hip is frozen. Tuesday I’ll go to the store to buy him a TV for his room and some other things he’ll need. The good thing is the center has a lot of parking so my mom can go herself and not depend on me for rides. It’s really frustrating to be in the middle of trying to troubleshoot a script or website and have her call and ask for a ride.

Have plans this weekend? I’d like to watch a movie, maybe the new copy of The Breakup I got will work this time and I can watch the entire thing. Depending on my designer, I either have a lot of new sites to put up and configure, or if he doesn’t come through, then I have a lot of older sites to update.

I’m hoping I can sleep properly and get rid of the stiff neck I’ve had now for a week. It’s really a pain in the neck, no pun intended. Then I have an issue with my thumb/wrist, but not my mouse/computer hand, the other one. I’ve been wearing a brace on it but it’s not helping as much as I’d like as it doesn’t immobilize my thumb totally. And no, no doctor, you know how I feel about going to one of “those.”

What a week so far

The good part of the week has been the weather where it’s been in the 50’s all week with no end in sight. My aunt (93) died this week but I hadn’t seen her in 25+ years.

Filed my court paperwork in Small Claims Court over my sink issue, and talked to a Federal official about this harassment via dating site issue and found out quite a bit of info.

I’ve made business decisions that allow me to sleep at night. Namely, I won’t put photos of anyone under age 21 on any of my websites. I won’t hire a model who looks under 21 or who is under 21, no matter how hairy she is. I am disgusted by the wealth of t*en websites on the ‘Net that depict girls looking undera*ed. I’m disgusted by the fact that when there are younger looking girl photos on a website, those are clicked more than the others.

Well, one domain registrar (no, not host) decided that 14 images on a website were “illegal content” and shut down someone’s sites. This person probably is losing a few grand a day due to this. The people who saw the images say the girls look 12 or 13. I won’t go look as I don’t want that shit in my cache. Only way to get rid of it is to destroy the hard drive. I’d rather make $10 a day promoting older looking hairy women than $2k a day promoting that te*n crap.

Ok, to other things. I’ll be transitioning this blog to other software over the next few weeks. When it’s happening I’ll post. The new design is going to cost a LOT more than I anticipated, so I’m waffling a little over using it again. Hey, I’m cheap.

I’ll be adding a new feature to the blog when it relaunches, though …. something y’all will really, really like, I guarantee.

Heard from my errant sex toy reviewer, the one with the few hundred bucks worth of toys. Oh yeah, she disappeared again for a few months but now claims she’ll have my reviews to me by the end of the weekend. Yeah, we’ll see …

Updated a ton of sites today, worked non-stop like a crazed woman. Ran to the store to get salad stuff for dinner and had 2 TV reporters shove microphones in my face to ask what I thought of the murder this week. Oh yeah, if you didn’t read about it, a man went into a strip club with semi-automatic weapons and killed 2 people and himself, shot 2 cops … and created mayhem with the SWAT team being involved. I told the reporter “no comment” and went into the store. Enough already. You have half a dozen people shot, 3 dead, families grieving at holiday time. Let it go already.

Ok, time to go update a new site … and my New Year’s Resolution is NO NEW WEBSITES!!!

Billy Preston died. I’m in shock. I saw him on some TV special last year and he looked about 70 years old and very sick. He was just 59 but apparently was in pretty bad health over the past few years, and went into a deep coma back in November and today,died. He was the 5th Beatle if you’ve never heard of him. In the 70’s he had a massive afro and was easily recognizable. He also wrote “You Are So Beautiful” for Joe Cocker.

I wish I had a video camera. Driving into Dunkin Donuts today and coming out is a white SS Chevelle, not sure if it’s 68 or 69 but it was gorgeous. On the way to the body shop (yes, again) I saw a white 1970 Mustang. At the body shop I found out that “ZZ Top Legs car” is actually a 1940 coupe. While there I saw a silver 1969 Camara being tweaked out.

Then, driving home I drove by a house that always has a 1968 Firebird in the driveway. My ex called it a BondoBird! I drove by and saw it in the driveway. At the next light I look in my rear view mirror and it’s right behind me. I got a great view of the front of the car which I’d never seen before.

I also saw my dream house and I plan to go back there with my camera to take pics. The stonework alone probably cost more than I earn in a year.

I’m back to seeing the chiropractor 3 days a week. Last year my ex ordered me an exhaust system and it weighed 40 lbs, but of course he wasn’t around when it was delivered so I had to bring it in from the porch, and slipped a disc in my upper neck and pinched a nerve. 4 months of chiropractic healed it and I saw 4 surgeons, had 3 MRIs and a CT scan as well. For the past couple of months it’s been fine and I’ve been pain-free.

Friday I helped someone move something, knowing I shouldn’t but I really had no choice, and Saturday my neck began hurting. By yesterday I was a wreck, so saw my chiropractor today and she said I was “really” out of place and the nerve is pinched again. It will take a month or two of adjustments to make me pain-free again, but sitting makes it really hurt, so I work for a bit, then sit elsewhere with an ice pack. So, I may not be posting as much for a few days and won’t be doing as much work for a while.

Little chilly … and a rant

I have the windows open but have to admit, it’s pretty chilly right now. I definitely will have to close them to sleep. Was a nice day, not too warm, didn’t need the a/c at all. All this money I save on a/c will go to the body shop, so it’s not a good thing! I may get it back tomorrow, depends if they need 4 hours to put it back together as that’s how long it took to take it apart.

Dermatologist appointment tomorrow, hopefully the last one and he’ll hopefully tell me my infected thumb is clearing up, err, not infected, fungal thumb.

Hope I sleep tonight, haven’t slept well in a few weeks. I’m not sure if it’s because I was quasi-dumped, the change in the weather, the change for daylight savings time or just one of those things. I also have been going to sleep earlier and that may be a problem, but I’m just so tired by 10 pm that I go to bed and read for a while.

Not sure if you’ve been reading the newspapers or watching the news but there have been 3 murders here in the past week. Seriously. First there was a shooting by 2 kids from a gang, one shot another 10 times and he died. He was caught with the gun in his hand though his accomplice got away and he’s not talking about who it was. The other kid shot is in critical condition a week later and he’s not talking. The shooter is in jail and 2 days later someone kills his mother. Really. Now, he doesn’t live with his mother, but he gave the police that address, so the newspapers printed it. It’s not like she lived in a bad area, either. It’s about 4 blocks from my chiropractor, and she just sold her house for $650k and lives among several million dollar homes. The neighborhood isn’t bad, but there is a “bad” housing project about 10 blocks down the street.

If that wasn’t bad enough, this weekend one of the Fairhaven High School seniors killed another. Seems 3 boys were involved in a house robbery in the middle of the night, one took off, the other 2 argued while driving and one stabbed the other and left him to die. He’s been arraigned and is in jail.

The gang stuff is bad because the shooting (10 shots) happened in downtown New Bedford, a tourist area off the waterfront. People are now a little afraid to go there. I grew up down there as my father had a business there. I haven’t gone downtown in a long, long time because there are parking meters and it’s a real pain to find a parking place. I think the last time I went there was to buy my ex some historic area T-shirts and a hat and maybe I’ve been there once since then. I’m not afraid to go there now, but there are neighborhoods that I won’t go to because of the drugs and constant problems involving gangs and guns. Downtown, though, isn’t that type of area.

Now what pisses me off is the father of the kid killed in Fairhaven making a stupid statement like “things like this don’t happen in Fairhaven” so it has New Bedford people thinking WE think we’re better than them, or we think we’re better than others. I surely don’t, and crime can happen in every town, no matter how large or how small.

Are the parents to blame? Why were 3 kids at age 18 or 19 out in the middle of the night? Where were the parents? Is it peer pressure?

Today began dreary. Went to the chiropractor and it was drizzling, cold and raw and about 40 degrees. By the time I went out around 12:30 pm it was no longer raining and within an hour it was 60 degrees, sunny and humid. You have to love New England weather.

Had my 8th laser appointment tonight and it wasn’t that bad. Hurt in a few spots but I guess my skin is getting used to it. As I was waiting another woman came in and she had fur on her forearms. I haven’t seen such hairy forearms in a very long time. She had an appointment with the girl who does the laser, but I’m not sure if she was having a facial hair removed, pubic hair removed or what. I didn’t want to ask my laser girl what she was doing on that woman but I sure was curious.

I would imagine a lot of hairy women go to various laser centers for work, but I’m also sure many of them who are very hairy may not have visible signs of their body fur.

Well, the manager of Great White got 4 years in jail but is eligible for parole in 16 months. Some of the relatives think he should have gotten life, others think the sentence was too harsh. I thought 2 years would have been sufficient, but then again I didn’t lose a relative in that fire, just friends. The real culprits, the owners of the club, go on trial shortly.

Still reeling over Chris being voted off of American Idol. It was THE talk of every talk show today, everywhere you went people were commenting on it. I heard an interview and Chris said that most likely were so sure he’d be in the top 2 that they stopped voting, and that did him in. I admit I have never voted for anyone, though I wish I had voted for Chris on Tuesday night. My pick for the winner now is Taylor Hicks, the grey-haired dude with the soulful voice. He’s Ray Charles, Michael McDonald and Joe Cocker rolled into one.

ICANN Board Votes Against .XXX Sponsored Top Level Domain Agreement

Marina del Rey, California, 10 May 2006: Today, ICANN’s Board of Directors voted against a proposed agreement for a .XXX. Sponsored Top Level Domain (sTLD). The application was proposed by the ICM Registry.

The application has received much public comment and detailed discussion by the ICANN Board. Reflecting the diversity of views this application has generated, the Board discussion at today’s meeting focused on the criteria for the sTLD, especially for sponsorship, and the terms of the contract proposed by ICM, including compliance issues related to key terms associated with public policy concerns. ICM had proposed additional terms in response to issues raised by ICANN’s Governmental Advisory Committee, particularly at ICANN’s meeting in Wellington in March.

I’m in shock and my jaw dropped tonight, Chris was voted off of American Idol. He was in shock, too, absolute shock. It was SO unexpected, especially since Katherine sucked so badly last night. He’ll have a great career as a rock singer with a heavy metal band but damn, it broke my heart to see him voted off.

The entire adult industry could change today

If you’re not aware of it, the government wants to make all adult websites use a .xxx TLD. ICANN is meeting today about it and I sure hope it’s not approved. First of all, I’ll probably lose most of my domain names to someone else. The cost for a .xxx domain will be about $70 a year. Considering I have 150 domain names …….. when I registered my first domain name it was $100 a year but I only had a single domain.

.xxx won’t protect children, it will make it easier for them to find porn on the Internet. It will also force most adult webmasters to simply most their hosting offshore so the .xxx rule won’t affect them.

I’d be all for it if you could prove to me it would stop child porn or stop under 18 year olds from looking at porn. If I had software for age verification on all my sites, what is to stop Johnny 13-year-old from lying about his age?

What about a PARENT supervising their kids?????

Plan to Tax Adult Internet Companies Revealed

WASHINGTON — Targeting those who are “profiting by exploiting children and promoting irresponsible and obscene behavior,” Sen. Blanche Lincoln, D-Ark., on Wednesday announced a regulatory assault on the online adult industry with legislation that would impose a 25 percent excise tax on all adult transactions.

Lincoln’s rally to support the new legislation is tied to a study by advocacy group Third Way, whose report exposes statistics linking children to online adult websites. The report’s release coincides with Lincoln’s announcement Wednesday morning in Washington.

Third Way’s report claims that children between the ages of 12-17 are the largest viewers of Internet pornography, and the average age at which children are first exposed to online pornography is 11 years of age.

“The Internet has become our new American Main Street, and it’s literally transforming the experience of growing up in America in a way much different from the way parents of today grew up,” Lincoln said.

“Many Internet service providers have taken significant steps to provide parents with tools to protect their children from inappropriate material online and they should be commended,” Lincoln said. “But sadly, many adult-oriented websites in today’s online world are not only failing to keep products unsuitable for children from view, but are also pushing those products in children’s faces. And it’s time that we stand up and say, ‘enough is enough.’”

Lincoln’s legislation, called the Internet Safety and Child Protection Act of 2005, has three objectives:

Force Online Adult Companies to Pay the Costs of Child Protection
The Internet Safety and Child Protection Trust Fund would be financed by a 25 percent excise tax on all online adult transactions.

Requires Age Verification
Online adult websites would be required to use software to verify the age of users attempting to access their websites. Online merchants, banks and credit card companies could not process payment transactions that are not age verified. The FTC would issue and enforce those regulations.

Establish an Internet Safety and Child Protection Trust Fund
The fund would centralize and coordinate the allocation of federal resources in support of efforts on the part of law enforcement and others to combat Internet and pornography-related crimes against children.

Original cosponsors of Lincoln’s legislation include Sens. Tom Carper, D-Del.; Mark Pryor, D-Ark; Mary Landrieu, D-La.; Joe Lieberman, D-Conn.; Debbie Stabenow, D-Mich.; and Ken Salazar, D-Colo.

Companion legislation also was introduced Wednesday in the U.S. House of Representatives by Rep. Jim Matheson, D-Utah and Rep. Robert Menendez, D-N.J.
